DECISION

That branch of the motion by appellant seeking an enlargement of time to perfect the appeal is granted and the appeal shall be perfected by January 8, 2010.

That branch of the motion seeking to compel the Justice Court of the Village of Tuxedo Park to file a return is granted and the Justice Court shall, within 21 days of service by appellant upon it of copies of the affidavit of errors and the order hereon, file with the clerk of this court the affidavit of errors and the court's return (CPL 460.10 [3] [d], [e]).
