On the court's own motion, it is
ORDERED that its decision and order on motion dated October 28, 2009, in the above-entitled matter, which granted a motion by the appellant on an appeal from a judgment of the County Court, Suffolk County, rendered January 19, 2006, is amended by deleting from the sixth, seventh, and eighth decretal paragraphs thereof the words "assigned counsel" and substituting therefor the words "appellant's counsel".
