Motion by the appellant to stay the respondent from enforcing a certain 10-day notice to quit the subject premises pending hearing and determination of an appeal from an order of the Supreme Court, Kings County, entered June 16, 2008, and to direct the respondent to show proof of the assignment of the subject mortgage.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied.
