Application by the appellant on appeals from a judgment of the Supreme Court, Queens County, dated January 29, 2009, and an order of the same court entered August 7, 2009, pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to perfect the appeal from the judgment dated January 29, 2009.

ORDERED that the application is granted and the appellant's time to perfect the appeal from the judgment dated January 29, 2009, is enlarged until January 9, 2010, and the record or appendix on that appeal and the appellant's brief must be served and filed on or before that date.

The appellant is entitled to consolidate the appeals as a matter of right and need not make a motion for such relief (see 22 NYCRR 670.7[c][1]).
