On the court's own motion, it is
ORDERED that its decision and order on motion dated October 20, 2009, in the above-entitled matter, which granted a motion by the appellant pro se, on an appeal from a judgment of the County Court, Suffolk County, rendered August 11, 2009, is amended by deleting from the first paragraph the date "August 11, 2008" and substituting therefor the date "August 11, 2009," and by deleting from the caption the indictment number "Ind. No. 1164-07" and substituting therefor the indictment number "Ind. No. 2680-07."
