ORDERED that its decision and order on motion dated October 29, 2009, in the above-entitled matter, which granted a motion by the appellant pro se, on an appeal from a judgment of the Supreme Court, Queens County, rendered June 19, 2009, is amended by deleting from caption the indictment number "Ind. No. 3379/08" and substituting therefor the indictment number "Ind. No. 379/08."
