ORDERED that its decision and order on motion dated October 5, 2009, in the above-entitled matter, which granted a motion by the appellant, on an appeal from a judgment of the Supreme Court, Kings County, is amended by deleting from the third decretal paragraph thereof the date "September 11, 2009", and substituting therefor the date "June 19, 2009".
