It is Ordered that the motion is granted to the extent of enlarging the time to perfect the appeal to the February 2010 term and continuing the stay. In the event of appellant's failure to comply with the orders of this Court, the landlord may move on five days' notice for an order vacating the stay. This is without prejudice to the petitioner seeking to dismiss the appeal as untimely, if so advised., by motion or in the responding brief on the appeal, along with supporting documents.
