DECISION & ORDER ON MOTION

Motion by the plaintiff for leave to appeal to this court from an order of the Appellate Term, Second, Eleventh, and Thirteenth Judicial Districts, dated June 23, 2009, which modified an order of the Civil Court of the City of New York, Queens County, entered July 1, 2007. Separate cross motions by the defendant Thomas Pinkerton and the defendants Avis rent A Car System, Inc., and PV Holding Corp., Inc., for leave to appeal to this court from the order of the Appellate Term, Second, Eleventh, and Thirteenth Judicial Districts, dated June 23, 2009.

Upon the papers filed in support of the motion and the cross motions, and the papers filed in opposition thereto, it is

ORDERED that the motions are denied.
