On the court's own motion, it is
ORDERED that its order on application dated November 18, 2009, in the above-entitled matter, which determined applications by the appellant-respondent and the respondent-appellant Tak Kwan pursuant to 22 NYCRR 670.8(d)(2), on an appeal and cross appeals from an order of the Supreme Court, Kings County, dated April 20, 2009, is amended by deleting from the second decretal paragraph the date "December 22, 2010" and substituting therefor the date "December 22, 2009."
