Motion by the respondents for leave to reargue an appeal from a judgment of the Supreme Court, Westchester County, dated April 9, 2008, which was determined by decision and order of this court dated September 8, 2009, or, in the alternative, for leave to appeal to the Court of Appeals from the decision and order of this court. Cross motion by the appellants to resettle or clarify the decision and order dated September 8, 2009.
