Motion by the appellants to stay the trial in an action entitled DeLuca v New York Racing Association, pending in the Supreme Court, Queens County, under Index No. 13955/05, pending hearing and determination of appeals from two orders of the Supreme Court, Nassau County, dated June 22, 2009, and entered September 17, 2009, for a preference in the calendaring of the appeals, and, in effect, for an expedited briefing schedule.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied.
