| DECISION & ORDER ON MOTION |
Motion by the appellant on an appeal from a judgment of the Supreme Court, Queens County, rendered January 3, 2007, to renew that branch of his prior motion which was to allow Joseph Gentile, Sr., Esq., to appear as attorney of record and argue the appeal at oral argument, which was denied by decision and order on motion of this Court dated October 1, 2009, with leave to renew upon proper papers, including an affidavit or affirmation of Joseph Gentile, Sr., Esq., stating that he has reviewed the appellant's brief which was filed April 9, 2009, and adopts it. Joseph Gentile, Sr., Esq., has now submitted an affirmation stating that he has reviewed the appellant's brief filed on April 9, 2009, and adopts it.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is granted.
