Motion by the appellant pro se to recall and vacate a decision and order on motion of this court dated August 7, 2009, which dismissed an appeal from a judgment of the County Court, Nassau County, rendered December 6, 2000, on the ground that he had abandoned the appeal (see 22 NYCRR 670.8[f]), to reinstate the appeal, and to enlarge the time to perfect the appeal.
Upon the papers filed in support of the motion and the papers filed in relation or opposition thereto, it is
ORDERED that the motion is denied.
