It is Ordered that the petitioner-respondent's motion to vacate the stay is denied, without prejudice to renew in the event the appellant fails to comply with the orders of this Court or in the event the appellant fails to provide immediate access to the basement / boiler area to the landlord. Petitioner's motion for an order directing the Commissioner of Finance to release funds on deposit is denied, without prejudice to renew in the event the appeal is not perfected by the next available term. The Court notes that this appeal has yet to be calendared for any term of this Court.
