DECISION & ORDER ON MOTION

Appeal by the defendant from an order of the County Court, Suffolk County, dated April 24, 2007, issued pursuant to Correction Law article 6-c. By order to show cause dated October 9, 2009, the parties were directed to show cause before this court why an order should or should not be entered dismissing the appeal as abandoned.

Now, on the court's own motion, and the papers filed in response to the order to show cause, it is

ORDERED that the motion to dismiss the appeal is denied; and it is further,

ORDERED that on or before January 6, 2010, the appellant shall either (1) perfect the appeal, (2) move for poor person relief and the assignment of counsel, or (3) retain counsel and notify the court of the name and address of retained counsel.
