| DECISION & ORDER ON MOTION |
Motion by the appellant pro se to waive the filing fee on an appeal from a judgment of the Supreme Court, Westchester County, entered April 3, 2008.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied; and it is further,
ORDERED that the appellant's time to perfect the appeal by paying the filing fee is extended until February 8, 2010, and, upon payment of the filing fee on or before that date, the briefs submitted to the Clerk of the court will be accepted for filing.
