Motion by the appellant, in effect, to recall and vacate a decision and order on motion dated October 20, 2009, dismissing an appeal from an order of the Family Court, Nassau County, dated August 10, 2009, for leave to appeal from the order, for counsel fees, and to stay all proceedings in the above-entitled action pending hearing and determination of the appeal.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied.
