DECISION & ORDER ON MOTION

Motion by the appellant pro se to relieve counsel assigned to prosecute an appeal from a judgment of the County Court, Nassau County, rendered February 26, 2008, and for the assignment of new counsel, and for leave to serve and file a supplemental brief.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is to relieve counsel assigned to prosecute the appeal and for the assignment of new counsel is denied; and it is further,

ORDERED that the branch of the motion which is for leave to serve and file a supplemental brief is denied as unnecessary as leave was granted by decision and order on motion of this court dated September 14, 2009.
