DECISION & ORDER ON MOTION

Motion by counsel assigned to prosecute an appeal from a judgment of the County Court, Suffolk County, rendered March 26, 2008, to be relieved on the ground that the appellant has, in effect, abandoned the appeal, by failing to respond to correspondence sent to him by assigned counsel.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that the motion is denied, as the appellant has now responded to correspondence sent to him by assigned counsel.
