| DECISION & ORDER ON MOTION |
Motion by Mark Diamond, Esq., counsel assigned to prosecute an appeal from a judgment of the Supreme Court, Westchester County, rendered March 5, 2009, to be relieved on the ground that the appellant has, in effect, abandoned the appeal, by failing to respond to correspondence sent to him by assigned counsel. Separate motion by the respondent to dismiss the appeal on the ground that the appellant has, in effect, abandoned the appeal.
Upon the papers filed in support of the motions and the papers filed in relation thereto, it is
ORDERED that the motions are granted, Mark Diamond, Esq., Box 287356 Yorkville Station, New York, New York 10128, assigned counsel for the appellant, is relieved, and the appeal is dismissed.
