Motion by the appellant, in effect, to deem the notice of appeal from a judgment of the Supreme Court, Kings County, rendered August 10, 2005, to be timely filed.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the motion is granted; and it is further,
ORDERED that on or before March 1, 2010, the appellant shall either (1) perfect the appeal, (2) move for poor person relief and the assignment of counsel, or (3) retain counsel and advise the court of the name and address of retained counsel.
