Appellants having moved for an extension of time to perfect the appeals taken from orders of the Supreme Court entered in the Office of the Clerk of the County of Erie on November 25, 2008 and January 29, 2009, and for an extension of time to file the notice of appeal from the order entered November 25, 2008,

Now, upon reading and filing the affirmation of Joseph S. Brown dated October 29, 2009, the notice of motion with proof of service thereof, the opposing affirmation of W. James Schwan dated November 3, 2009, and due deliberation having been had thereon,

It is hereby ORDERED that the motion be, and the same hereby is, granted to the extent that the ordering paragraph of the order of this Court entered September 8, 2009 is hereby amended by deleting the date October 30, 2009 and inserting in its place the date January 29, 2010, and appellants shall file the notice of appeal with the Erie County Clerk on or before December 31, 2009.
