It is Ordered that the tenants-respondents' motion to dismiss, as untimely, the notice of appeal from the September 30, 2009 Civil Court order, is denied. In the event that the appeal from said order is not perfected by the March 2010 term, the respondents may move on five days' notice for an order dismissing the appeal for failure to diligently prosecute.
