DECISION & ORDER ON MOTION

Motion by the defendant Tarek Hussain to stay his eviction from the subject premises, pending hearing and determination of an appeal from an order of the Supreme Court, Queens County, entered April 20, 2009, and to enlarge the time to perfect the appeal.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is dismissed on the ground that Tarek Hussain is not a party to this appeal, without prejudice to the appellant making a motion for the same relief.
