Application by the appellants-respondents pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to perfect an appeal from a transcript of the Supreme Court, Queens County, dated April 2, 2009, and cross application by the respondent-appellant for the same relief.
Upon the papers filed in support of the applications and no papers having been filed in opposition thereto, it is
ORDERED that the appeal and cross appeal are dismissed, without costs or disbursements, as no appeal lies from a transcript (see Ojeda v Metropolitan Playhouse, 120 AD2d 717); and it is further,
ORDERED that the application and cross application are denied as academic.
