ORDERED that its decision and order on motion dated December 1, 2009, in the above-entitled matter, which determined a motion by the plaintiff-respondent, on an appeal from an order of the Supreme Court, Dutchess County, dated November 25, 2008, is amended by deleting from subsection (5) of the final decretal paragraph the words "page 8" and substituting therefor the words "page 12."
