| DECISION & ORDER ON MOTION |
Motion by NYSED Vocational Educational Services for Individuals with Disabilities for leave to appeal to this court from a purported order of the Supreme Court, Kings County, dated October 1, 2009, and to stay all proceedings in the above-entitled matter, pending hearing and determination of the appeal.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the branch of the motion which is for leave to appeal is denied on the ground that no appeal lies from a purported order (see CPLR 5701); and it is further,
ORDERED that the branch of the motion which is to stay all proceedings in the above-entitled matter is denied as academic.
