| DECISION & ORDER ON MOTION |
Motion by the New York City Housing Authority for leave to appeal to this court from an order of the Supreme Court, Kings County, dated October 2, 2009, and, inter alia, to confirm that an automatic stay pursuant to CPLR 5519(a)(1) is in effect concerning the order pending hearing and determination of the appeal.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the branch of the motion which is for leave to appeal is granted; and it is further,
ORDERED that the branch of the motion which is to confirm that an automatic stay pursuant to CPLR 5519(a)(1) is in effect concerning the order is granted and it is confirmed that enforcement of the order dated October 2, 2009, is stayed pending hearing and determination of the appeal (see CPLR 5519[a][1]); and it is further,
ORDERED that the motion is otherwise denied.
