DECISION & ORDER ON MOTION

Motion by the respondent for an order extending the effective date of his suspension for 60 days. By opinion and order of this court dated September 15, 2009, the respondent was suspended for a period of two years, commencing October 15, 2009, based on three charges of professional misconduct emanating from his filing a false instrument for filing with a governmental agency. By an order to show cause of a Justice of this court, cause dated October 15, 2009, the effective date of the suspension was stayed pending determination of the respondent's motion. The respondent was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on February 11, 1975, under the name John Joseph Budnick.

Upon the papers submitted in support of the motion and the papers submitted in relation thereto, it is

ORDERED that the motion is granted to the extent that the effective date of the suspension is extended to December 18, 2009, solely for the purpose of winding down the respondent's practice with respect to existing matters and clients, and the motion is otherwise denied.
