| DECISION & ORDER ON MOTION |
Motion by the appellant to stay enforcement of stated portions of a judgment of the Supreme Court, Nassau County, entered July 16, 2009, pending hearing and determination of an appeal therefrom, for a reconstruction hearing, and to enlarge the time to perfect the appeal.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to stay enforcement of stated portions of the judgment is denied; and it is further,
ORDERED that the branch of the motion which is for a reconstruction hearing is denied with leave to renew, if necessary, after receipt of the transcripts listed in the letter dated October 6, 2009; and it is further,
ORDERED that the branch of the motion which is to enlarge the time to perfect the appeal is denied as premature.
