Motion by the petitioner pro se to stay his eviction from the subject premises pending hearing and determination of a proceeding pursuant to CPLR article 78, which was transferred to this court by an order of the Supreme Court, Kings County, dated July 28, 2009, and for leave to prosecute the appeal as a poor person.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied.
