ORDERED that its decision and order on motion dated December 7, 2009, in the above-entitled matter, which granted a motion by the appellant to enlarge the time to serve and file a supplemental brief on an appeal from a judgment of the County Court, Orange County, rendered October 4, 2007, is amended by deleting the last paragraph thereof.
