Motion by the appellant for leave to withdraw his motion to serve and file a supplemental pro se brief on an appeal from a judgment of the County Court, Orange County, rendered January 23, 2008, which was granted by decision and order on motion dated July 29, 2009.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the motion is granted, the decision and order on motion of this court dated July 29, 2009, is recalled and vacated, and the appellant's motion for leave to file a pro se brief is deemed withdrawn.
