Motion by the respondent to dismiss an appeal from a judgment of the Supreme Court, Kings County, rendered December 6, 2002, for failure to timely perfect.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied with leave to renew if the appellant does not move for poor person relief and to restore the appeal to active status on or before January 21, 2010.
