ORDERED that its decision and order on motion dated December 8, 2009, in the above-entitled matter is recalled and vacated, and the following decision and order on motion is substituted therefor:
On the court's own motion, it is
ORDERED that counsel assigned to represent the respondent Leonard H. on an appeal from an order of the Family Court, Queens County, dated October 21, 2009, is relieved of the assignment and is directed to turn over all papers in action to new counsel herein assigned.
The motion of Leonard H. motion for assignment of counsel was granted on November 24, 2009, and the following named attorney was assigned to prosecute the appeal:

and it is further,

and it is further,
ORDERED that assigned counsel shall promptly attempt to contact the respondent Leonard H., at the address provided by the court, and shall notify the Case Manager assigned to the appeal on or before December 30, 2009, in writing, that she has done so and that either
(1) the respondent Leonard H. is interested in responding to the appeal, or
(2) the respondent Leonard H. is not interested in responding to the appeal, or that she has been unable to contact the respondent, and wishes to be relieved of the assignment.
ORDERED that assigned counsel is directed to serve a copy of this order upon the Clerk of the court from which the appeal is taken.
