Respondent-appellant having moved for an extension of time to file and serve a brief on the appeal and cross appeal taken from an order of the Onondaga County Surrogate's Court entered in the Office of said Court on December 17, 2008,

It is hereby ORDERED that the motion be, and the same hereby is, granted on condition that the brief is filed and served on or before January 14, 2010, and the Clerk is directed to accept the brief for filing, and
It is further ORDERED that reply briefs, if any, shall be filed and served on or before January 29, 2010, surreply briefs, if any, shall be filed and served on or before February 12, 2010, and the appeal and cross appeal are hereby removed from the calendar for the term of this Court commencing February 22, 2010 and added to the calendar for the term of this Court commencing April 5, 2010.
