Appeal by Glenn Ngan from an order of the Supreme Court, Queens County, dated September 2, 2008.
Now, on the court's own motion, it is
ORDERED that the appeal is dismissed, without costs or disbursements, as the order is not appealable as of right and leave to appeal has not been granted (see CPLR 5701), and because this appeal is a duplicate of an appeal pending under Appellate Division Docket No. 2008-09217, which was dismissed by decision and order on motion dated October 23, 2008.
