Application by the appellant to recall and vacate a decision and order on application of this court dated November 30, 2009, deeming her notice of appeal from an order of Supreme Court, Queens County, entered January 26, 2009, to be a notice of appeal from a judgment of the same court entered March 23, 2009, and to withdraw the appeal.
Upon the papers filed in support of the application and no papers having been filed in opposition thereto, it is
ORDERED that the application is granted, the decision and order on application of this court dated November 30, 2009, is recalled and vacated, and the appeal is marked withdrawn.
