Motion by counsel assigned to represent the defendant in the County Court, Rockland County, to be relieved of the assignment to respond to an appeal by the People from an order of that court dated October 28, 2009.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is denied with leave to renew on or before January 4, 2010, upon proper papers including proof of service of the motion upon the defendant.
