Motion by the appellant pro se for leave to withdraw his supplemental brief on an appeal from a judgment of the Supreme Court, Queens County, rendered November 28, 2006.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is granted, the supplemental pro se brief filed on July 28, 2009, and the respondent's brief in response to the supplemental pro se brief filed on September 28, 2009, are stricken, the decision and order on motion of this court dated May 14, 2008, which granted the appellant's motion for leave to file a supplemental brief is recalled and vacated, and the motion for leave to file a supplemental pro se brief is denied.
