Appellant having moved for substitution of counsel on an appeal taken from a judgment of the Ontario County Court, rendered October 3, 2008,
Now, upon reading and filing the affirmation of William G. Pixley, dated December 2, 2009, the notice of motion with proof of service thereof, the affirmation of Steven D. Sessler, dated December 14, 2009, and due deliberation having been had thereon,
It is hereby ORDERED that the motion be and the same hereby is granted, and the order of this Court entered December 5, 2008 assigning Steven D. Sessler to perfect the appeal is vacated and Steven D. Sessler is directed to return all papers and transcripts to the Ontario County Clerk, and
It is further ORDERED that the appeal may be prosecuted upon one record as defined by 22 NYCRR 1000.3(c)(1) and 10 copies of an appellant's brief, reproduced in accordance with 22 NYCRR 1000.4(f), and
It is further ORDERED that the Ontario County Clerk is directed to provide William G. Pixley with copies of all papers and transcripts of stenographic or audiotaped minutes, if any, of all proceedings upon which the appeal is based.
