On the court's own motion, it is
ORDERED that its decision and order on motion dated December 2, 2009, in the above-entitled matter, which determined a motion by the respondent on an appeal from a judgment of the Supreme Court, Richmond County, dated April 7, 2009, is amended by deleting from the second paragraph thereof the words "the papers filed in opposition thereto," and substituting therefor the words "no papers having been filed in opposition or in relation thereto."
