On the court's own motion, it is
ORDERED that its decision and order on motion dated October 27, 2009, in the above-entitled appeal, which granted a motion by the defendant, on an appeal from a judgment of the Supreme Court, Kings County, rendered September 11, 2007, is amended by deleting from the second decretal paragraph thereof the date "January 8, 2010," and substituting therefor the date "February 23, 2010".
