DECISION & ORDER ON MOTION

Motion by Stanley Stos to enlarge the record on an appeal from an amended order of the Supreme Court, Kings County, dated March 7, 2008, to include an order of the same court dated August 28, 2008, and to enlarge the time to serve and file a brief. Separate applications by Stanley Stos and Phyliss Gelb pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to serve and file their respective briefs.

Upon the papers filed in support of the motion and the papers filed in opposition and in relation thereto, and upon the applications, it is

ORDERED that the branch of the motion which is to enlarge the record is denied; and it is further,

ORDERED that the branch of the motion which is to enlarge Stanley Stos's time to serve and file a brief and the applications are granted and the time of Stanley Stos and Phyliss Gelb to serve and file their respective brief is enlarged until January 30, 2009, and the briefs of Stanley Stos and Phyliss Gelb must be served and filed on or before that date.
