Motion for Poor Person Relief
and to Assign Counsel

On the court's own motion, it is

ORDERED that its decision and order on motion dated August 20, 2008, in the above-entitled case, which granted a motion by the defendant, on an appeal from an order of the Supreme Court, Kings County, dated June 4, 2008, is amended by deleting the sixth decretal paragraph thereof and substituting therefor the following decretal paragraph:

"ORDERED that the appellant's time to perfect the appeal is enlarged; assigned counsel shall prosecute the appeal expeditiously in accordance with this court's rules (see 22 NYCRR 670.1, et seq.) and written directions; and it is further,"
