Motion by the plaintiff, inter alia, for leave to appeal to the Court of Appeals from a decision and order of this court dated August 18, 2009, which determined an appeal from an order of the Supreme Court, Kings County, dated June 22, 2007 (Appellate Division Docket No. 2007-08750) and a decision and order of this court also dated August 18, 2009, which determined an appeal and cross appeal from a judgment of the same court entered August 21, 2008 (Appellate Division Docket No. 2008-08191)
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied.
