It is Ordered that the motion is granted only to the extent of continuing the stay to and including February 9, 2010. If, by said date, the appeal has been perfected and the appellant is current in the payment of use and occupancy, then the appellant may move for a continuation of the stay. The petitioner's objection to the respondent-appellant obtaining poor person status, including obtaining the transcript at the state's expense, by Ex Parte order of the Civil Court dated November 24, 2009, is denied without prejudice to renew in the trial court.
