It is Ordered that the motion is granted to the extent of continuing the stay of the execution of the warrant of eviction through January 14, 2010. If, by said date, the arrears outstanding [ $864.82], along with the January 2010 use and occupancy, have been tendered to the petitioner and the appeal has been perfected , then the appellant may move for an order continuing the stay. Otherwise, the warrant of eviction may be enforced after January 14, 2010 and the appeal is dismissed, once again.
