Motion by the plaintiff for leave to appeal to this court from a transcript of the minutes of the proceedings of the Supreme Court, Nassau County, on December 21, 2009, and, inter alia, to award him temporary custody of the parties' daughter pending hearing and determination of the appeal.
Upon the papers filed in support of the motion and the papers filed in opposition and in relation thereto, it is
ORDERED that the branch of the motion which is for leave to appeal is denied; and it is further,
ORDERED that the motion is otherwise denied as academic.
